rivers in international law 国际法上的河流 河流如果完全在一国领土之内,属国内河流;如果标示领土边界,为边界河流;如果为一个以上的国家所有,则为多国河流。对多国河流,沿岸国可以在各自的所属河段内管理航行,并可拒绝非沿岸国船舶航行。流经数国领土并通往海洋,根据国际条约向所有国家的商船开放的河流,则为国际河流。国际河流制度于19世纪开始出现于欧洲。1815年维也纳公会承认了在欧洲的国际河流上的航行自由原则,如斯凯尔特河、默兹河、莱茵河及其可航支流。1856年《巴黎和约》〔Peace of Paris〕规定了多瑙河上的航行自由。一战后的许多和约也宣布了其它一些国际河流。1921年国际联盟举行的巴塞罗那会议通过了《国际性可航水道制度公约及其规约》〔Convention and Statute on the Regime of Navigable Waterways of International Concern〕。
